Consumer forum grants relief to flat purchaser


The additional Pune district consumer forum has directed a builder to complete construction of flats and hand over possession to the flat owners in 30 days.

The builder has also been ordered to pay compensation of Rs25,000 to the complainant. If the builder fails to give possession in 30 days, he will have to pay additional compensation at the rate of Rs250 per day.

The order was passed on a complaint filed by Yerawada resident, Ashok Shankar Kale against Sankalp Constructions proprietor, Prabhakar Bhosale of Dhanori.

Kale, in his complaint, stated he executed a sale deed for a flat with Sankalp Constructions on November 1, 2004 for Rs2.8 lakh and took a loan from the General Insurance Company. The insurance company paid Rs1.5 lakh to the builder, who agreed to give possession of the flat in 14 months.

Kale had to pay monthly installments of Rs2,730 to GIC for loan repayment. When he approached  Bhosale, the latter asked him to cancel the earlier contract and sign a new one for Rs4 lakh.

Kale approached the forum on December 11, 2007. Bhosale told the forum he had to pay to the GIC some money as Kale did not pay some monthly installments.

President of the forum, Pranalee Deshmukh on March 12 directed Kale to pay Rs1,62,074 to Sankalp Constructions and ordered the company to complete construction and give its possession with occupancy certificate to Kale.
