Gujarat Congress cries foul over speaker's hesitance to disqualify BJP MLA Pabubha Manek

The seven-time MLA and former minister Manek's election from Dwarka Assembly constituency had been nullified by the Gujarat High Court due to defective nomination form.

A Congress delegation led by Gujarat Congress president Amit Chavda and Leader of Opposition Paresh Dhanani on Wednesday sought disqualification of BJP MLA Pabubha Manek in connection with his 'defective' nomination form. The seven-time MLA and former minister Manek's election from Dwarka Assembly constituency had been nullified by the Gujarat High Court due to defective nomination form.

The Congress said that despite the HC order of April 12, he was yet to be disqualified. "The speaker is being partial," said Congress leaders after meeting with speaker Rajendra Trivedi. The delegation among others included Gujarat Congress president Amit Chavda and Leader of Opposition Paresh Dhanani.

The delegation also sought action against OBC leader Alpesh Thakor, who had announced last month that he was resigning from all the posts in the party. Since then, there have been talks that Thakor will be joining the BJP, something that he has time and again denied.

Earlier too, the party had made a representation before the speaker seeking his disqualification.

Citing the partial behaviour of the speaker, the Congress leaders speaking to the media said that while Trivedi was quick to disqualify Congress MLA Bhagvan Barad and independent MLA Bhupendrasinh Khant, he was not showing similar urgency when it came to BJP MLAs.

Barad, who had won from Talala had been disqualified following his conviction in an illegal mining case in February. The SC had later stayed the by-election for the constituency.

Khant, an independent MLA from Morva Hadaf in Panchmahal district, was disqualified on May 3, weeks after the HC invalidated his caste certificate. The HC said that Khant, who was elected from the tribal-reserved seat, did not belong to ST community.

"The speaker is supposed to be a non-partisan and not indulge in politics. Why is he dragging his feet when there is no stay even from the SC in the matter of Pabubha Manek," questioned Chavda.

He said the speaker told them that Manek's salary as an MLA was blocked and he would not be allowed to attend any meeting. "However, when we asked for a copy of the order that shows the measures being implemented, he refused," said Chavda.

Congress leaders said Speaker Trivedi was quick to disqualify Congress MLA Bhagvan Barad and independent MLA Bhupendrasinh Khant but the similar urgency was missing when it came to BJP MLAs
