The court today directed Lodha Developers to file their reply to a public interest litigation alleging that the developers were giving possession of flats at a newly announced scheme even before the occupation certificate was issued.

The PIL alleges that the scheme for the new township at suburban Dahisar was announced by Lodha developers few days after the Thane Municipal Corporation issued stop work notice to them for another luxury township project 'Casa Univis', which comprises of 26 towers.
"Brochures were distributed on March 12 for the upcoming project - Lodha Aqua - calling for bookings. The brochure announces a discount of up to Rs 7.5 lakh for those persons who book flats between March 7 and April 4," the PIL states.
"However, there has been no mention of issuance of Occupation Certificate for the project. How can the developer call for bookings," petitioner's advocate Sumedha Rao argued.
A division bench of Chief Justice Mohit Shah and Justice DG Karnik directed the developers to file their reply by March 30.
According to the petition, the civic body had on February 23 issued stop work notice for Casa Univis township after violations in three buildings were revealed. While seven floors were approved, the developer had built 18 floors.
"The civic body also does not do anything in the beginning. After the construction is over, a stop work notice is issued after which the developer agrees to pay the fine to regularise the unauthorised structure," Rao said.
