No advance bail, 4 Thane corporators to surrender

With a view to averting any adverse remarks from the court, the four Thane municipal corporators alleged to have abetted the suicide of developer Suraj Parmar withdrew their anticipatory bail applications filed before the Bombay high court on Tuesday, after the court rejected their pleas.

Justice Ajey Gadkari, dismissing the applications on the grounds of withdrawal, directed them to surrender before the police on Saturday by 9 am. "Considering the enormous magnitude of the offence and gravity of the case, the applications stand rejected. The interim relief grated to them by way of not to arrest till the final hearing was also vacated." They were asked whether they would surrender or appeal against the order and proceedings were adjourned post lunch break.

The four corporators, Vikrant Chavan of the Congress, Najib Mulla, Hanumant Jagdale, both NCP, and Sudhakar Chavan, an independent, had moved the high court in November after the Thane sessions court rejected their anticipatory bail plea.

The four contented they were not involved in the suicide of the developer and had complained only against illegal constructions being carried out in Thane area by not only the deceased but others developers as well. Further, it was argued that since they belong to the opposition parties they were being implicated. They have been cooperating in the probe and custodial interrogation was not required.

Special Public Prosecutor Raja Thackeray had strongly opposed the pleas on the ground that the police need to probe the money trail angle of the accused and since they were having major political clout the TMC officials were not coming forward to give details. Only if they are in custody would they do so. In one of the hearing he also argued that the police also needed to find out the details of money transferred from an accused account to NCP MLA Jitendra Awhad.

The Thane police had registered a case after a notebook containing handwritten notes left by Parmar in his car as his suicide note revealed names of these accused, who allegedly "harassed'' him. Parmar had scratched out the names and explained the deletion out of fear that they would harass or harm his family.

Parmar had shot himself on October 7. His suicide note alleged that a nexus of corporators and officials was harassing him for bribes.
