Bombay High Court discharges owner of Maya Lounge in 2012 booze party case

The Bombay High Court has discharged Anjali Rajnish Nirmal, wife of a police inspector and the owner of Maya Lounge, where Pune Rural Police had carried out a raid in the year 2012 and busted a party going on way past the stipulated deadline of 11 pm.

Justice Mridula Bhatkar, on the plea challenging the lower court orders said, “I do not find any indirect participation in the offence by the petitioner. On perusal of the record before the court and especially on going through the terms of the agreement, I am of the view that there is no material against the petitioner to frame charge for the offences for which she is prosecuted. It is the case of discharge.”

Advocate Manoj Gadkari, appearing for the accused, charged under sections of Bombay Prohibition Act and Bombay Police Act, argued “Immediately after raid, the accused has terminated the contract with Red Entertainment & Services. The said property is sold to some other person. Petitioner is no way concerned with the breach of the terms of contract of license which were obtained by the lessee (Red Entertainment &Services). The orders passed by the lower courts are not legal and hence, need to be set aside.”

Advocate Pallavi Dabholkar, appearing for the prosecution opposed the plea saying, “Petitioner, being the owner of the premises, is supposed to have knowledge of the activities which are going on in the premises.” However, the court after going through the evidence noted, “This view taken by both the Judges and the prosecution may be useful in the civil cases to impose tortious liability. However, in the criminal law, it is essential for the prosecution to verify what offence is committed by the accused.”

The police had in the wee hours carried out a raid at Wagholi’s Maya Lounge about 20 kilometre from Pune. They found 300 boys and girls shouting and dancing; they were also drunk. Music was being played on Disk Jockey well past the permissible time limit.
