Section 302 of the Indian Penal Code carries the punishment for murder, which is death or life imprisonment, along with being liable to a fine.
Mob lynching victim Tabrez Ansari's wife Shaista Parveen today said that she will commit suicide if the accused are not charged with murder and hanged.
"If the murderers are not charged with Section 302 of the IPC and hanged," she said, "I will commit suicide."

On June 18, 2019, Tabrez Ansari was thrashed by a mob in Jharkhand's Dhatkidh village over suspicion of bike theft. However, his family has always denied any such accusation on Tabrez.
"The whole world knows how my husband died but nobody in the administration is ready to stand with us," his wife said.
Earlier, too, she had said that there was an attempt to save the culprits and urged that the CBI should investigate the case.
"My husband was lynched, the earlier case was registered under section 302 (murder) but it was later changed to section 304 (culpable homicide) under administration's influence," she said.
Mohammad Mehbbo, a relative of Shaista Parveen also said that they want CBI investigation in the case.
Meanwhile, the Jharkhand Police had on Wednesday said that the charge sheet against 11 accused persons in Tabrez Ansari lynching case has been filed under section 304 of the Indian Penal Code (culpable homicide not amounting to murder), as the murder case (section 302) could not be made based on the findings of post-mortem report.
The police added the difference between section 304 and section 302 is that the former warrants provision for life imprisonment while the later contains the provision for the death sentence.
