CBI registers cases against Tihar jail staff for thrashing 18 inmates

The Central Bureau of Investigation (CBI) has registered two cases pertaining to Tihar Jail violence that took place last year in which 18 inmates were allegedly beaten up by the prison staff. The agency has registered cases following Delhi High Court order to take over the probe.

The court had ordered investigation into the matter hearing public interest litigation (PIL) filed by advocate Chinmay Kanojia, who has pleaded that his client Shahid Husuf was brutally beaten up inside the jail premises without any reason by the jail officials. In the petition, it was alleged that he and several other inmates were beaten up by the Tamil Nadu State Police (TSP) and the quick response team (QRT). Husuf, son of Hizbul Mujahideen chief Syed Salahuddin, is being probed in a 2011 terror funding case being probed by the National Investigation Agency (NIA).

On November 21, 2017, inmates lodged in a high-risk ward in jail number 1 of Tihar jail were allegedly beaten up. Jail official, however, stated that they it was other way wherein they were beaten up by inmates and also had alleged that solgan of Pakistan Zindabad were chanted.

High court, however, said that the matter needs to be probed and formed two three-member fact finding committees. The panel in its report had stated prisoners in the high-risk ward of jail number 1 feared for their lives. "They apprehend that they might be killed on some pretext and are expecting an assurance that no physical harm would come to them," the report stated.

In May this year, High Court had ordered a CBI enquiry against prison officials saying it "cannot condone custodial violence".

Ordering CBI probe into the matter, a two member bench stated, "We are not going to condone custodial violence. Not in this city. Accused or convicts — after all, they are human beings who were in your custody. Law is equal for all, whether it's a man in uniform. The law does not change for anyone."

The agency registered two cases into the matter and have collected all the reports and files pertaining to the case from the Hari Nagar police station as well as from the committee.
