Channel sends legal notice to a film for using a title that is similar to their show.
True to its name, the now popular term ‘Emotional Atyachar’ is causing a lot of heartache to those associated with it.
The term was first popularised in a song in director Anurag Kashyap’s film Dev D. Soon after, a television show was launched with the term as the title and it put couples through a loyalty test to see if they were cheating on each other.
All was fine till the channel on which the show is aired learnt of a feature film with the likes of Kalki Koelchin, Ranvir Shorey and Vinay Pathak being made with the same title. Says a channel spokesperson,
“The use of the name in the film amounts to ‘passing off’ since it is deceptively similar and/or is identical to the name of the channel’s popular reality show. We got to know of the movie only a month back and have sent the production house a legal notice. If they don’t respond, we’ll take it to the next level.”
Vijay Gutte, producer of the film confirms this. “I was in Singapore when the notice was sent. But my grouse is that the title of my film, is The Film Emotional Atyachar and not just Emotional Atyachar. I have registered the said title with the Indian Motion Pictures’ Producers Association (IMPPA) and if there was a problem the party should have approached the association then. I don’t think IMPPA would’ve given me the title, without clearing the matter with the channel in the first place. Now they are asking for compensation to the tune of Rs 50 lakh,” says Vijay.
Vijay adds, “Now, it’s too late to change the title as a lot has been invested in the promotions. Also, the rights have been sold to Roopvati Pictures, so technically any grouse will now have to be taken up with them and not us.”
