BEST asked to pay Rs9 Lakh to youth its bus dashed in 2005

Mumbai Motor Accident Claims Tribunal has held the BEST responsible for an accident one of its buses caused in 2005, which rendered a (now) 22-year-old youth disabled. The tribunal directed the BEST to pay a compensation of Rs9 lakh along with a 7.5% interest rate on the amount from 2005.

The tribunal observed: "After going through the evidence brought on record, the tribunal is convinced that the boy from the age of 12 years, when the accident had occurred, has suffered a huge impact on his future and career. He is unable to enjoy his life as he used to before the accident as his normal life has been totally disturbed. Also his marriage prospects are also badly affected because of his disability."

The case dates back to March 28, 2005, when Bilal Khan Arif Khan (22), then 12 years old, who was studying in the sixth standard, was on his way back home from school at around 3.45 pm.

The moment the boy reached Andheri-Kurla road near Bohari cemetery, a BEST bus, which was speeding, dashed into the boy, causing grievous injuries to Khan.

The impact was such, that there were numerous cracks on his leg, his heel was dislocated, injuries on his ankle, and Khan lost a lot of blood as well.

After going through the complaint filed by the 22-year-old, the tribunal asked the BEST to file its reply. In its reply, BEST said that they were never at fault, and instead, claimed the fault was that of the victim, since he was 'doing mischief while walking on the streets'. The BEST thus requested the tribunal to dismiss the complainant's plea.

The tribunal heard the arguments advanced by the complainant as well as the BEST, and also went through the FIR copy, which is registered against the driver of the bus; it was convinced by the complainant's case and thus penalised the BEST.
