SC stays criminal proceedings in land deal around Jal Mahal

The Supreme Court on Friday stayed criminal proceedings in a Jaipur court which had issued arrest warrant against four persons including senior IAS officer Vinod Zutshi in connection with alleged illegal leasing of land around 16th century Jal Mahal in Rajasthan's capital.

A bench comprising justices P Sathasivam and J Chelameswar issued notice to the Rajasthan Government on the petition filed by Nav Ratan Kothari, owner of Jal Mahal Resorts Private Limited and accused in the case, challenging the proceedings in the trial court.

Besides Zutshi and Kothari, the Jaipur court in September last had also issued arrest warrants against a Rajasthan Administrative Officer Hridesh Kumar and one Rakesh Saini for alleged corruption in the land deal.

The high court had dismissed their anticipatory bail applications in connection with the case.

The government land adjoining Mansagar lake was handed over on lease for 99 years by Rajasthan Tourism Development Corporation (RTDC) to Jal Mahal Resorts for developing tourist facilities around the lake.

Zutshi, who is presently Deputy Election Commissioner, was the RTDC Chairman in 2005 when the land lease deal was finalised. Kumar and Saini, who were his subordinates at that time, were also involved in the deal.

The deal got mired in controversy when objections were raised as to how the government land could be leased out for 99 years instead of 30 years, which is akin to selling it.

A Jaipur resident, Bhagwat Gaud had lodged a criminal complaint against the alleged conspiracy by the government officers and the businessman concerned.

The land initially belonged to the JDA, JMC and the PWD but was transferred to the RTDC which handed it over to M/s Jal Mahal Resorts for developing tourist facilities around the lake.
