The building’s owner, Sukhibai Voral, who wants to redevelop the property, had earlier got an order in her favour, thus evicting the police chief.
The police commissioner has taken eight rooms on rent in Sukhi Nivas building on Mahul Road to be used as official service quarters.
Last week, advocate GW Mattos told the Bombay high court: “The state had passed an order ruling in favour of the police commissioner.
Thus, the earlier order of the Controller of Accommodation passed in favour of the landlady/developer is set aside and they cannot develop the property in view of the earlier high court order granting status quo.”
The owner and developer challenged the order in the high court. Mattos sought time to file his reply. The next hearing is on March 7.
In 1961, Voral moved an application before the Controller of Accommodation for de-requisiting the property in possession of the police. The order was passed in favour of Voral. However, she allowed police commissioner to be her tenant.
In 2000, Voral got into a redevelopment agreement and again moved an application to evict the police commissioner. In 2009, the Controller of Accommodation passed an ex-parte order evicting the police commissioner. Then police commissioner D Sivanandhan moved the General Administration Department, challenging the order. In March 2010, it was directed to hear the plea afresh.
After the BMC sent a notice to the developer stalling redevelopment, he challenged the order.
