Congress moves Gujarat High Court to debar Alpesh Thakor, Dhavalsinh Zala

The Congress party has once again moved the Gujarat High Court challenging the inaction of Assembly Speaker Rajendra Trivedi in deciding the applications seeking disqualification of former Congress MLA from Radhanpur Alpesh Thakor and Bayad MLA Dhavalsinh Zala under the provisions of the anti-defection law.

The petition has been preferred by Congress chief whip in the Assembly Ashwin Kotwal, who has sought a direction that Thakor and Zala should be disqualified and won't be allowed to contest election for the remaining tenure of the fourteenth assembly.

When the case was taken up for hearing by the division bench of Justice SR Brahmbhatt and Justice AP Thaker, assistant government pleader Utkarsh Sharma sought time citing that the copy of the petition was not served. Sharma requested the court to adjourn the hearing of the case till Monday, which was agreed by it.

According to the petitioner, Thakor had voluntarily given up the membership of the Congress party for which the party filed an application seeking his disqualification under the provisions for anti-defection as mentioned in the tenth schedule of the Constitution. The same was allegedly not adjudicated by the speaker.

Thereafter, Thakor allegedly again incurred disqualification by voting contrary to the mandate of the Congress party during the recently held Rajya Sabha election. A separate disqualification petition was preferred by the party, but instead of adjudicating on the same, the speaker accepted the resignations tendered by both Thakor and Zala.

The Bayad MLA too had voted in contravention of the party's mandate and both of them later joined the BJP. on.
