Have complaint against a judge? File an affidavit, submit proof

In order to curb frivolous complaints being filed against judges and members of state judiciary, the Bombay high court has made it mandatory for people to submit their grievances in the form of an affidavit along with verifiable material to substantiate the allegations.

In order to curb frivolous complaints being filed against judges and members of state judiciary, the Bombay high court has made it mandatory for people to submit their grievances in the form of an affidavit along with verifiable material to substantiate the allegations.

A notice issued by the HC dated April 7 reads: "A complaint making allegations against members of the District Judiciary in the state will not be entertained and no action will be taken thereon, unless it is accompanied by a duly sworn affidavit and verifiable material to substantiate the allegations made therein."

Registrar General of the HC, Mangesh Patil, said: "The notice has been issued following directives of the Supreme Court."

However, the notice does not mention whether any action would be taken against the complainant, who had given the complaint in an affidavit, but the same were found to be false after an inquiry.

A high court official, who did not wish to be named, said that the issue of action in case of false complaint will be dealt with later as and when required. "That (action in case of false complaint ) was not before consideration at this point. It will be looked into later."
