Brazil watchdog fines Apple Rs 14.4 crores for not including charger with iPhone 12 series

As per Procon-SP, Apple gives "misleading advertising as iPhone 11 Pro consumers reported that Apple didn't repair their phones after water problems.

Apple’s latest iPhone 12 comes without a charging adaptor. The news was disappointing, but Apple lovers eventually made peace with it.

But according to latest reports, Procon-SP, the Brazilian consumer protection regulator on Friday (March19) fined Apple for not including a charger in the iPhone 12 box.

Apple was charged a whopping penalty of USD 2 million (approx 14.4 crores) or 10,5 million in Brazilian Real “for misleading advertising, selling a device without the charger and unfair terms,” according to a report by 9TO5Mac.

As per the website, this is not the first time that the Brazilian consumer watchdog questioned Apple about its new policy. 

In November 2020, the agency said that the iPhone maker "didn't demonstrate environmental gain.” 

According to Procon-SP, Apple is giving "misleading advertising as iPhone 11 Pro consumers reported that Apple didn't repair their phones after problems with water". 

The agency also cited "iOS update problems," and "unfair terms" as other issues as "Apple exempts itself from all legal and implicit guarantees and against hidden or not apparent defects".

Procon-SP also asked Apple if the price of iPhone 12 has decreased after removal of the charger and what is the price of the iPhone with and without the charger, but says Apple hasn’t responded to these queries.

“Apple needs to understand that in Brazil there are solid consumer protection laws and institutions. It needs to respect these laws and these institutions,” Fernando Capez, the Executive Director of Procon-SP was quoted as saying.

Meanwhile, Apple is yet to comment on Procon-SP charges.

According to The Verge, the fine is unlikely to hurt Apple as the company had reported $114.4 billion in revenue in the first quarter of 2021.

Apple in October last year announced that the iPhone 12 would not come with chargers or earbuds in their boxes, citing environmental concerns. The new iPhones come with only a USB-C to Lightning cable. 

According to Apple, this move will reduce 2 million metric tonnes of carbon, which is equal to removing 450,000 cars in one year.
