Mumbai: Sessions Court changes penalty from one month to a single day

The Sessions Court while deciding on an appeal matter which was filed in the year 2014, held that the lower court had given a wrong punishment to two accused and altered the one month's punishment to one day's punishment. The court while altering the punishment held that the punishment had to be such that it should pass a message to the society, but should not be much in accordance with the crime proven.

The Sessions Court while passing orders held that just to ensure that a wrong message is not passed to the society, it is essential to punish the accused.

According to the prosecution's case, Dinesh Chawala and his father Ramesh Chawala, residents of Borivali, had filed an appeal against a judgment which was passed by the lower court in connection with a fight in which they were arrested in the year 2010. The accused and the victims were neighbours and did not share healthy neighbourhood relations.

On May 30, in 2000, when the fight broke out, accused father-son duo, assaulted the victim with a tube light and a wooden stump. The victim was hospitalised, but injuries were not major. The Sessions Court, thus altered the punishment saying victim was not severely hurt and accused do not deserve the one-month-long punishment.
