Conciliation between homebuyer and developer yield better results

The data accessed from Maharashtra Real Estate Regulatory Authority shows that more than 78% cases that reached the conciliation forum were completed. While the figure stands at 64% where MahaRERA has passed an order on complaints received against registered and unregistered projects.

The Alternate Dispute Redressal system, received a total of 552 conciliation request from both the parties. Of which currently 57 conciliation requests are in process and 434 requests are those where the forum has managed to complete the conciliation process. Whereas MahaRERA has received a total of 8,787 complaints against registered and unregistered projects. Of this 8,181 complaints are against registered projects and 5,310 orders have been passed. Whereas the number of complaints against unregistered projects stood at 606 and orders have been passed in 330 cases, taking the total of orders passed to 5,640.

Rajesh Prajapati, a prominent developer and also a conciliator with the Conciliation Forum has heard over 30-40 cases and has resolved more than 80% of his cases said that, conciliation is doing good because at the first stage itself both the homebuyer and the developer have agreed to have a amicable solution for the problem.

The conciliators from both sides are trained, they are taught on various aspects on how to deal with cases connected to real estate and what are the option available. There are several rounds of training for the conciliators.

Advocate Shirish Deshpande, chairperson, Mumbai Grahak Panchayat, said, "Conciliation works because in most cases the biggest thing missing is communication between the developer and the homebuyers, here we bridge that gap. They both shift from their original stand and settle the matter," said Deshpande.

  • According to the conciliation forum, about 50% of the cases are resolved in the first hearing, there are very few that reach the second or third hearing. There are several rounds of training for the conciliators
