Rajasthan High Court orders DGP to speed up investigations

According to the court, the DGP is head of the police force. He must ensure timely completion of investigation so that people’s faith on the police remains intact.

Rajasthan high court has asked DGP to create a mechanism for timely investigation of cases. The court had summoned the DGP for unending investigation in criminal cases. 

The court has also given the police one month’s time to complete investigation in the case against former MLA Virendra Meena for allegedly assaulting Dr Kirori Lal Meena’s guard. The court said that if investigation report indicts the former MLA then he would be free to file a fresh petition. Justice KS Ahluwalia gave this order while disposing of Virendra Meena’s eight year old criminal petition. 

The court had asked the DGP to appear before it regarding inordinate delay in investigation. DGP O P Galhotra, ADG PK Singh and SP Anshuman Bhomia along with other police officers appeared in the court. 

The court said that some criminal cases have been pending for a decade. The police without assigning any reason changed the investigation officer. In the same matter, two investigation officers gave different opinion.

According to the court, the DGP is head of the police force. He must ensure timely completion of investigation so that people’s faith on the police remains intact.

The DGO replied that investigating officer is changed only on complaint of concerned parties in a case. The court intervened saying that it should not be done in a mechanical way rather investigation officer should be replaced only if there is solid reason. 

The court also said that there should be a monitoring system over investigating officer. The delay affects investigation.

In the concerned petition, it was stated that Bholuram, guard of then MLA Kirori Lal Meena filed a complaint in Lalsot police station on February 16, 2018. He alleged that a day before the complaint, he was travelling with Kirori Lal Meena in a car when another car tried to hit their vehicle. 

When the car stopped, a person came out from the other car and thrashed him (Bholuram) and damaged his uniform. People identified the attacker as Lalsot MLA Virendra Meena on which basis he named him in the FIR. 
It was challenged by Virendra Meena claiming that the complaint was politically motivated hence it should be quashed. Since, the investigation was still not complete, the court called up the DGP and issued directives.
