Allahabad High Court bans DJ in Uttar Pradesh, asks govt to release toll-free number for complaints

In its judgment, the court said that the complains can be made through email, SMS or WhatsApp as well.

If you planning to play loudspeakers and DJs this festive season in Uttar Pradesh, it can land you in big trouble. 

The Allahabad High Court has banned DJs across the state and if someone is found guilty, they can be sentenced up to five years and may have to pay a hefty fine of Rs. 1 lakh. Citing the issue of noise pollution, the court ruled out the decision and has asked the govt to ensure that no noise pollution rules are violated in the state.

 

The decision was given by Justice PKS Baghel and Justice Pankaj Bhatia of Allahabad High Court after public interest litigation was filed by advocate Sushil Chandra Shrivastava, an Allahabad native.

The court has also rejected the DJ applications approved by District Magistrates and Magistrates of the state with the immediate effect.  The High Court has also ordered the UP government to impose a strict action against people playing DJs and impose a fine of one lakh rupees and imprisonment for up to five years if they are found guilty. 

The court has said that there is a violation of basic rights of citizens by playing high volume DJs and creating noise pollution.

The court has said the police station in-charge will be accountable for the proper implementation of the order. In its judgment, the court said that the complains can be made through email, SMS or WhatsApp as well. The court assured that the name and identity of the complainer will be kept confidential. 

The court has also ordered to issue a toll-free number for complaints of noise pollution.

Allahabad HC asked authorities to categories the cities in the state into industrial, commercial, residential or silence zone for regulating noise pollution in the state.
