Gujarat assembly on Monday passed the bill giving approval to anyone to open a restaurant in the state without the license of the local authority. The Gujarat government presented the Gujarat Police (Amendment) Bill, 2018 in the House which was passed with majority of votes.

The bill suggested removing the provision of acquiring licence from police or local administration authorities to open or run the eateries. While presenting the bill, the minister of state for home, Pradipsinh Jadeja said, "The government had received many representations from the restaurant owners that they faced many issues during issuance or re-issuance of the license for the establishments. Adopting the sensitive approach towards the sector, we have decided to remove that provision from existing act. This would give a new boost to this sector which is small but is growing at constant space. This amendment would give them space to grow with more speed."

Several Congress MLAs agreed to make the act hassle-free for the small entrepreneurs but also alerted the government that the control of the system over such restaurants should not be kept in abeyance so that the restaurant owners did not compromise with quality. The government assured that the bill would not affect on such parameters as there was a separate mechanism in administration to check the quality of foods sold at eateries. The Gujarat government also passed the bill unanimously amending the VAT Act on the same day. This new bill would allow the government to keep collecting taxes from the commercial establishments during and after the court trial on disputes with the government on tax collections. The finance minister Nitin Patel said in the house that the bill would enable the government to exclude the tenure between final order and appeal period for tax collection.

The government also presented the Appropriation Bill in the house that was passed unanimously. The bill authorised the expenditure of government funds as the budget grants earmarked for the year 2018-19. With this, the house gave the sanction to the budget of government and implementation of budget grants shall start.

PRIVATE UNIVERSITIES BILL

The Gujarat government will table three more bills for the sanction of the house on Tuesday. The bills include The Registration (Gujarat Amendment) Bill that suggests to make registration of power of attorney of assets mandatory at concerned registrar office. Another bill is making amendment in Gujarat Stamp Act that suggests changes in original act as per the latest amendment made by the central government in the main act. The government will also table the private university bill on Wednesday.

“It’ll give hoteliers a major relief. Getting a license and getting them renewed is very complicated,” said Shailesh Patwari, GCCI president. Hiren Gandhi, chairman of Food Committee, GCCI, said it is justified for resident hotels to have police permission as they accommodate strangers.
