Gujarat High Court grants temporary bail to DPIL's Sumit Bhatnagar

The temporary bail was granted to Sumit after he approached the court for the same on the ground of providing parental care to his dyslexic daughter, who is supposed to appear for the class 10 board examination.

In a temporary relief to Sumit Bhatnagar of Diamond Power Infrastructure Limited (DPIL), who is behind bars in the Rs 2,654 crore bank fraud case, the Gujarat High Court on Tuesday, granted him conditional bail for the period between January 12 and 26. The temporary bail was granted to Sumit after he approached the court for the same on the ground of providing parental care to his dyslexic daughter, who is supposed to appear for the class 10 board examination.

A single judge bench headed by Justice Sonia Gokani granted the temporary bail on the condition that the movement of Sumit during the above tenure will be limited amid his home and his daughter's school, and to a medical practitioner, if required. Interestingly, Sumit and his brother Amit have also filed a plea for regular bail, which is pending before the court.

During Tuesday's hearing, the Central Bureau of Investigation (CBI), which is probing the matter, submitted the updated probe report to the court in a sealed cover. Thereafter, the court questioned the investigation officer P Ghodeshwar to clarify its stand on the temporary bail plea of Sumit. The CBI officer opposed the temporary bail plea on the ground that it is yet to record the statement of several witnesses in the case and Sumit might tamper with evidence, if released from jail.

Senior advocate Yatin Oza submitted before the court that Sumit be released on temporary bail to provide parental care to his daughter, who has learning disability and is supposed to appear for her class 10 board examination. He also said his client will restrict his movement amid his house, his daughter's school and a doctor's, if required.

The medical reports of Sumit's daughter was also produced. The reports mentioned that his daughter does have learning disabilities. Following the submissions, the court eventually granted temporary relief to the accused.

CASE DETAILS

  • The Bhatnagar brothers had moved the High Court after their bail plea was rejected by a special CBI court in May, 2018. CBI had registered a criminal case in March 2018 against the Bhatnagar brothers and their father Suresh, all promoters of DPIL, for fraudulently availing credit facilities from a consortium of 11 banks since 2008, leaving behind an outstanding debt of Rs 2,654.40 crore as on June 29, 2016.
     
  • CBI had further alleged that the company and its directors managed to get loans and credit facilities despite the fact that they were already featuring in the Reserve Bank of India's defaulters list and ECGC caution list at the time of initial sanction of credit limits by the consortium.
