Lindsay Lohan might finally get a break from being charged with grand theft after she was accused of stealing a necklace from a store.

A mystery witness has stepped forward to say he previously considered purchasing the exact same necklace and the same store quoted him a drastically lower price, Lohan's father told RadarOnline.com.

"He went into the store way before Lindsay did and was interested in buying the necklace," the New York Daily News quoted Lohan as telling Radaronline.com.

"They told him it was for $800."

This would be critical since $950 is the threshold at which petty theft becomes felony grand theft. And prosecutors have said the necklace is worth $2,500.

Lohan faces up to three years if convicted and has signalled she's interested in a plea deal.
