Now, pay more for illegal construction

Various depts have decided to re-challan all those found violating the construction and demolition norms with higher penalty

Taking stringent steps to curb the rising pollution levels in the national Capital, various departments have now decided to re-challan all those found violating the construction and demolition norms, with an even higher penalty. Information about the offenders has already been sent to the National Green Tribunal (NGT).

In addition, the officials concerned have been asked to revisit the sites that have been fined previously, said sources in the Delhi government. 

As per the figures submitted by the East Delhi Municipal Corporation to Lieutenant Governor Najeeb Jung, it has taken action against 638 violators and collected over Rs 52 lakh in fine. “Defaulters have now been re-challaned and their information has been sent to the NGT for higher penalty. Besides, 149 challans have been issued to building material shops and a fine of Rs 2 lakh imposed. As many as 352 challans have been issued to polluting factories and 13 factories have been sealed,” said an EDMC official. Sources said the north and south MCDs are likely to follow. 

Meanwhile, according to the government data, 11 Delhi Pollution Control Committee (DPCC) teams, along with the Revenue Department, have inspected 496 sites and issued 289 challans amounting to nearly Rs 89 lakh. The Public Works Department (PWD), which had not issued any challans in October, has also issued 129 challans with a fine amounting to Rs13,20,000.

The East Delhi Municipal Corporation has issued 408 challans for burning of waste, the south corporation filed a ‘Nil’ report and the north corporation did not submit an action taken report. “The corporations have been ordered to ensure that no construction norms are being flouted in the national Capital and to take action against repeat offenders,” a government official said. 

On April 10, 2015, the green court had ordered the authorities to stop all activities that violated the Environment Impact Assessment Guidelines issued by the Union Ministry of Environment and Forests in 2010.

The mandatory norms to be followed include covering the scaffolding around buildings with tarpaulin, no storing of construction materials on roads, covering of construction materials on the site and during transportation, and workers to be provided with dust masks. 

The tribunal had directed all the agencies concerned to ensure that while giving “sanction of land”, these guidelines were followed. It had added that anyone, owner or builder, who violated these regulations would be fined Rs 50,000. In addition, those violating norms while transporting construction debris or material would have to pay a penalty of Rs 5,000.

Meanwhile on Monday, LG Jung ordered strict enforcement of the ban of diesel generator sets and firecrackers, especially during marriages, and asked the Delhi Police to take strict action against offenders.
