Rais Khan not to contest court decision to prosecute him

Rais Khan, a former aide of Teesta Setalwad, today said he will not contest yesterday's order of special court, hearing 2002 Naroda Gam riot case, to prosecute him and others who were involved in fabricating evidence.

Rais Khan, a former aide of Teesta Setalwad, today said he will not contest yesterday's order of special court, hearing 2002 Naroda Gam riot case, to prosecute him and others who were involved in fabricating evidence.

Designated judge SH Vohra had yesterday rejecting Khan's application to become a court witness in the Naroda gam case where 11 persons of minority community were killed during riots on February 28, 2002, ordered to prosecute him and others involved in fabrication of evidence.

"With this order not only me but 'others' like Teesta Setalvad, Soheil Tirmizi (advocate) and office bearers of CJP who were instrumental in preparing false and fabricated affidavits will also face the trial. I was simply a paid employee of Setalvad and my role was limited to getting them signed and notarised," Khan said.

Khan said he was satisfied with the order and has decided not to challenge it in high court and will face the trial to ensure that real culprits are punished, no matter even if he is also punished along with them.

Khan had moved an application in the court to turn as a witness in Naroda gam riot case, after witnesses in the case Nanumiya Malik and Madina Banu, during their deposition in the trial had accused Khan of manipulating and inserting extra   paragraphs in their affidavits filed before the Supreme Court.

In the affidavits filed before the Supreme Court, serious allegations like murder and rape had been levelled against certain accused. The affidavits were put before the SC with a prayer to shift the trials of the riots cases outside Gujarat.

In his application to turn witness, Rais Khan had passed the buck on Teesta Setalvad, secretary of Citizens for Justice and Peace (CJP) for the fabrication.

Khan said that he is innocent and was not competent and involved in drafting of affidavits which will prove after the investigation of e-mail accounts of Teesta Setalvad, Soheil Tirmizi and his own.

The court in its order yesterday had observed that Khan has admitted that he had acted on somebody's orders in making false affidavits, which shows that he was involved in the offence, he said.

Court had ordered the registrar of the city sessions and civil court to register an offence against Khan and others under section 193 to 200 (all pertaining to fabrication of evidence and making false statements) of Indian Penal Code.
