92-year-old gets 10 years in prison for raping mentally challenged minor girl

A 92-year-old on Saturday was sentenced to 10 years in prison by a special court in Rajasthan's Bhilwara for raping a mentally challenged minor girl in 2009.

The convict was also slapped a fine of Rs 50,000 by the Additional Sessions Judge (women atrocities) Himankani Gaur for sexually assaulting the minor girl, according to a Hindustan Times report.

On December 18, 2009, a case was registered in Bhilwara Kotwali police station against the then 84-year-old Harlal Balai for raping a minor girl in her house at his village.

The incident ocurred when the minor girl's parents were not in the house and the convict took advantage of the situation and sexually assaulted her, public prosecutor Savita Sharma said. The mentally-challeneged girl was not in the condition to understand what had happened to her. It was when the girl's parents came back and saw her deteriorated condition, they filed a police complaint.

The victim and the convict belong to the same village and they knew each other. The victim used to adress Balai as 'baba'.

In a separate case, an elderly man was arrested on April 15 for raping his mentally challenged neighbour, aged 21, in Delhi's  Shahadra. Police said the accused took the woman to his cycle-rickshaw garage nearby and raped her. He was arrested after the victim disclosed the matter to her family.

According to the initial probe, on the pretext of getting the victim food and sweets, the accused took her to his garage. Then he locked the room and started touching her inappropriately. When the woman objected and started to raise her voice, he covered her mouth and assaulted her. He then raped her and warned her against revealing the matter to anyone. The accused then left for his home, a senior police officer said.
