DTH providers to pay for service

New GR directs service providers to deposit Entertainment Tax by the 10th of every month

With the advent of Direct to Home (DTH) broadcasting service, the state government has now come out with guidelines for DTH service providers, in terms of disclosing the number of connections and the entertainment tax payable. Henceforth, all DTH service providing companies will have to give such details to the government in a prescribed format on stamp paper.

The need for issuing the government resolution (GR) in October last year was felt after a survey, conducted by the government on the number of cable connections in the state, revealed alarmingly low figures of around 10 lakh connections in Mumbai.

Sources in the Revenue Department revealed that instead of targeting the local cable operators the government has now decided to charge the DTH service providers.

Sources however clarified that the government’s role in this respect is merely restricted to collection of entertainment tax. Matters of dispute over charges, is taken care of by the Telecom Regulatory Authority of India (TRAI).

As per the latest GR, on the basis of the number of connections the DTH service providers have, they will have to deposit entertainment tax to the government by the 10th of every month.

The DTH service providers will have to register themselves with the prescribed officer, which in this case is the district collector, so that tax can be deposited centrally. The service providers will have to obtain necessary license for depositing tax with the government. The service providing companies will have to give details of the district-wise connections and the tax they are collecting from the consumers to the government, along with records of challans.

Any delay in depositing tax will invite a penalty. The respective district collector in turn will have to keep a record of the accounts of each company. By November each year, the service providers will have to apply for renewal of necessary licenses and permissions.

Besides this, the companies will also have to give details of the exact number of connections to the district collector by 5th of each month.
