What treatment will ‘Munnabhai’ doctor give patients, wonders Bombay high court

Granting no relief to an MBBS student caught cheating in an examination paper, the Bombay high court on Thursday said, “If a person is found indulging in a malpractice, it is difficult to understand what kind of treatment such a doctor will give his patients.”

The court was hearing a petition filed by GS Medical College student Gajanan Mitke, whose attempt in the last year of MBBS was annulled by the controller of examinations after he was caught with a chit in his pocket before he answered the last paper of the examination held in June this year.

On June 3, Mitke was appearing for the paediatrics paper. After the answer sheets were distributed, the supervisor checked all the candidates and found a note in Mitke's pocket. His performance for the entire examination was annulled. He was contesting this order before the high court.

Mitke’s petition states that he prepared the notes for “refreshing his memory” and forgot to leave them outside the hall. His counsel argued that he had not even attempted to copy. Justices PB Majmudar and Mridula Bhatkar said he had not voluntarily come forward to surrender the chits but given them up when the supervisor caught him.

Mitke’s counsel said he may have been inspired by the film Munnabhai MBBS. Justice Majmudar said that even if the actor cheated in the movie, he did not treat patients. “If you treat children with such a degree and if some child dies, people will point a finger at us and say the high court allowed you (to become a doctor).”

Turning down Mitke’s petition, the court said he should put in rigorous efforts to clear the exam on merit next year.
