Court rejects bail plea of Malegaon accused

The high court the plea because the government’s appeal against the dropping of the MCOCA charge would be rendered infructuous if the accused were granted interim relief.

The Bombay high court on Thursday refused to grant interim bail to Malegaon bomb blast accused Lt-Col Shrikant Prasad Purohit and Ajay Rahirkar. Arguing for the accused, advocate Shrikant Shivde told the court that they had no forum to seek interim relief because the special court that had dropped the MCOCA charge from the September 2008 blast case had sent the case to a sessions court.

The high court, however, rejected their plea because the government’s appeal against the dropping of the MCOCA charge would be rendered infructuous if the accused were granted interim relief. The case has been adjourned till January 11.
