Court paves way for riverside roads in Pune

In a major development, rejecting the NGO Parisar’s appeal against the construction of a road on the riverside in the city, the district court on Thursday ruled that the Pune Municipal Corporation (PMC) has the right to build such a road.

In a major development, rejecting the NGO Parisar’s appeal against the construction of a road on the riverside in the city, the district court on Thursday ruled that the Pune Municipal Corporation (PMC) has the right to build such a road. The judgement has ratified the present riverside road stretches along the Mutha river in the city — from Mhatre Bridge to Sambhaji Bridge (3.2km) in Deccan Gymkhana area and from Sambhaji Bridge to Shivaji Bridge (0.9km).

Work on these two stretches started a decade ago but came to a halt following the trial court stay order in 2000. It remained in an unfinished condition since then. After the trial court ruled in favour of the PMC in 2007 and lifted the stay, the civic body completed the remaining work overnight before the NGO approached the higher court.

Idhate said Parisar had challenged the road plan in the PMC court in 2000. After the court ruled in favour of the PMC in 2007, the NGO
challenged the decision in the district court.

She said that district judge, VB Kulkarni, ruled that the civic body has the right to build the road under section 205 of the Bombay Provincial Municipal Corporation (BPMC) Act, 1949.

The legal advisor said that the court has ordered the petitioners to pay the cost of the case in trial court and district court to the PMC. It also observed that the petitioners had not taken the court’s permission before filing public interest litigation.

Bidkar said the judgement has also cleared the way for building the proposed road from Shivane to Kharadi along the Mutha river. He would conduct a review meeting with civic officials on Friday about development of the road.

The PMC standing committee in February 2011 had approved Rs307 crore for the riverside road project from Shivane to Kharadi (22 km). The panel had decided to carry out the project on design, build, own and transfer basis.
