Plea in POTA court to discharge 2002 Ghatkopar blast accused for lack of evidence

The DCB-CID had filed a report stating they have failed to find any evidence against Qureshi in the case and thus requested the court to discharge the accused.

The Special Prevention of Terrorism Act (POTA) court on Tuesday, presided by judge SM Bhosale, discharged Irfan Qureshi, who was arrested three months ago in connection with the 2002-Ghatkopar blast case due to lack of evidence. The DCB-CID had filed a report stating they have failed to find any evidence against Qureshi in the case and thus requested the court to discharge the accused.

According to the prosecution, the accused was allegedly a partner in a company that was shut just before the 2002 blast. The prosecution held that there were a few books like the Al Qaeda manual, allegedly recovered from the company premise, which indicated that the accused played a part in the blasts.

The agency filed a six-page document before the court stating, "The agency has investigated the matter but it failed to gather any evidence against the accused. We found that the prime reason for the accused to go to the Middle East was just because his mother was suffering from cancer. He left India in November 2002 to provide financial assistance to his family. Also, the blast took place in December 2002, which further hints at the accused not being privy to the blast."

The report further says that police had sent the data seized from his laptop and given it to the Forensic Science Laboratory (FSL) to check if it had any terror-linked material, but the reports were clean. "Further, the agency has checked the personal details of the accused to find if he had any links with terror organisations like the SIMI but found none. The agency has also considered the POTA committee's report, where the family of the accused had filed a complaint, but even those reports were clean and did not name Qureshi," read the reports. The agency added that the other accused in the case were acquitted by the court and thus on grounds of parity, this accused should also be discharged.
