The Brihanmumbai Municipal Corporation (BMC) will refer the case of the Malad West Human temple to a state government committee headed by the chief secretary, to take a call on its demolition, after the temple trust presented documentary evidence to support its claim that the temple has been existing there since 1948.

Following an order from the Bombay High Court, the BMC has been demolishing illegal shrines across the city.

On Wednesday, a team from the civic body was at the temple site to carry out the demolition. However, the locals opposed the BMC's move and halted the demolition. The BMC had to call off the drive after the locals staged a protest till late night on Wednesday. Gopal Shetty, BJP MP from Mumbai North was also present to oppose this move.

The Sonya Maruti Sewa Samiti Trust claimed that the temple has been existing since 1948 as they have documents as evidence. "In 1948, the then BMC chief certified that the temple was existing prior to 1948," said Shetty.

He added that we met the Chief Minister to intervene in the matter and stop the demolition. "We have received assurance from both the CM and the BMC that the temple will not be demolished immediately," said Shetty. He added that if the temple is creating obstacles in the smooth flow of traffic, they will have no problem in shifting the location provided they are given an alternate place.

Now, we will send the matter to state government review committee which is headed by chief secretary for a final call on whether the temple be shifted or demolished," said Nidhi Chaudhary, deputy municipal commissioner (Removal of Encroachment).
