The Dindoshi Sessions Court on Monday granted bail to advertising agency owner Indrajeet Nattoji in a case wherein Nattoji, allegedly under the influence of alcohol, had rammed his vehicle into three members of a family on the night of April 3, killing a 62-year-old man and his five-year-old grandson and severely injuring the child's mother.

According to the Oshiwara police, on April 3, 45-year-old Nattoji, while allegedly drunk, lost control of his white Volkswagen car and hit the three pedestrians, including Sarthak Polekar and his grandfather Bhiku Polekar, who were heading towards their residence in Gorai, Borivli (W) from Oshiwara.

Nattoji had reportedly fled from the spot leaving the car behind, before being caught by members of the public.

These members of the public then handed Nattoji over to the Oshiwara police, who booked him under relevant sections of the Indian Penal Code for culpable homicide not amounting to murder, and under the Motor Vehicle Act for negligent driving.

"My client had applied for bail wherein we had stated that the deceased people were crossing the road from the wrong side. They neglected the approaching vehicle coming at a high speed and continued to cross the road. This incorrect way of crossing the road led to the accident. The amount of alcohol my client had consumed was less than the permissible limit," said Ninad Majumdar, Nattoji's defence counsel.

He added: "Nattoji had spent almost 28 days in police custody and according to the police, no further statements are required to be recorded with respect to this accident. My client was granted bail on the payment of a cash bail bond of Rs50,000 and has also been told to visit Oshiwara police station every Thursday and Sunday until the police files the charge sheet in the case."
