Another PIL against tainted doctor Ketan Desai

One more Public Interest Litigation (PIL) has been filed against the uncontested victory of tainted doctor Ketan Desai in the senate elections held by the Gujarat University (GU).

The PIL has sought to declare Desai's victory illegal and direct the vice-chancellor (V-C) of GU to hold fresh elections.

The PIL has been filed by an NRI Dr. Kunal Saha, the president of People for Better Treatment (PBT), an NGO which is primarily involved with prevention of corruption and promotion of better healthcare in India.

The PIL is likely to come up for hearing on Monday. Interestingly, a PIL has already been filed earlier by a former senate member of GU in connection with the same issue and its hearing is also scheduled on Monday.

Ravish Bhatt, counsel for PBT, submitted in the PIL that the uncontested election of Desai to the GU senate as a candidate for a 'registered medical graduates' seat occurred in  the most illegal and arbitrary manner. 

Desai was not even a registered doctor when he got elected on November 28, 2010 which is illegal as stipulated under Section 16 of the senate rules. 

Moreover, the tainted doctor was also facing serious criminal charges for bribery and disproportionate assets before the Central Bureau of Investigation (CBI) court in New Delhi when he was elected.

Bhatt further stated that Desai obviously had no moral or legal rights at this stage to run for a vital post in the senate for a seat which is exclusively reserved for candidates who are registered medical graduates. 

Obviously, Desai cannot be considered a 'registered medical graduate' from October 9, 2010 when his medical registration was suspended by the MCI, the PIL stated.
