Also, women will be permitted to work during night shifts, provided there are provisions of shelter, rest room, ladies toilet, adequate protection of their dignity and transportation etc.
The Union cabinet, chaired by Prime Minister Narendra Modi, on Wednesday approved the Model Shops and Establishment (Regulation of Employment and Conditions of Service) Bill, 2016. The Bill will now be sent to states/UTs to enable them to modify their individual Acts, if they so desire.

Yuva Sena chief Aaditya Thackeray, who had mooted the idea, told dna that this was "overdue". While referring to the criticism of the proposal (including that by BJP leaders), he claimed that chief minister Devendra Fadnavis may have faced "internal pressure".
Last year, Aaditya had met Fadnavis seeking that commercial establishments in non-residential and business areas be allowed to stay open through the night.
"I'm glad at least the central government has realised what I proposed more than three years ago. The Mumbai proposal wanted keeping affordable eateries, cafes, chemists, milk vending shops and malls open at night in non-residential areas," Aaditya told dna in a text message.
"Mumbai is a city of hard-working people, a city that never sleeps. Those who work overnight need affordable places to eat. Those who have worked hard till late night need a place to step out with friends and family for a bite.
Today only cafes in 5-star hotels are open," he added.
However, sources said that allowing shops and commercial establishments to stay open 24X7 would have ramifications for Mumbai's law and order situation and pointed to objections by residents to a popular juice centre in the suburbs operating late into the night.
"In exceptional circumstances, the state can allow it for a group (like during festivals) or establishments," he said, adding that permitting it across the board would stress the police and Railways further.
It will cover only establishments employing 10 or more workers except manufacturing units.
The Bill provides for freedom to operate 365 days in a year and opening/closing time of establishment.
Women to be permitted during night shifts
No discrimination against women in the matter of recruitment, training, transfer or promotions
Clean and safe drinking water.
Lavatory, creche, first aid and canteen by group of establishments.
Five paid festival holidays in addition to national holidays
Exemption of highly skilled workers (for example workers employed in IT, Biotechnology and R&D division) from daily working hours of 9 hours and weekly working hours of 48 hours subject to maximum 125 overtime hours in a quarter.
