Aam Aadmi Party member seeks evidence in poll-code breach case against PM Narendra Modi

City-based AAP member Nishant Verma, who has sought pressing of additional charges against the Prime Minister Narendra Modi in the poll-code violation case, today sought copies of the documentary and other evidence collected by the police.

Verma filed an application before a local court seeking summons to the crime branch of city police in this regard. Advocate KR Koshti, his lawyer, contended that his client wanted to verify the evidence collected by the police.
As the government sought time to file reply, chief judicial magistrate AU Jhujharu adjourned the hearing to October 9.

On April 30 this year, when the voting was underway for 26 Lok Sabha seats in Gujarat, Modi addressed a press conference after casting his vote in Ranip area here, and also displayed his party's symbol, lotus.

On the directive of the Election Commission, crime branch lodged a first information report against Modi under the IPC and Representation of People Act as holding a public meeting when the voting is underway violates the law.

The crime branch filed a closure report on August 8 giving clean chit to Modi. Magistrate MH Patel accepted it.

But Verma filed a complaint before Ahmedabad rural court, demanding that Modi should be additionally charged under sections 130 of RPA and IPC sections 114 and 171 (c).

Under section 130 of the RP Act, a person is prohibited from canvassing for votes or exhibiting any notice or signs relating to the election within the polling station on the day of polls. IPC section 114 is about the role of abettor.
Section 171(c) is about exercising `undue influence' at an election.
