Max twins case: DMC issues notice to 9 docs, 2 nurses

The Council has sought a response regarding the qualifications and other details of the registration of the Delhi Nursing Council.

The Delhi Medical Council (DMC) has issued notices to nine doctors and two nurses of Max Hospital, located in northwest Delhi's Shalimar Bagh, for alleged negligence on their part in the recent case of a newborn who was declared dead by the hospital, but found alive while on the way to the funeral.

The Council has sought a response regarding the qualifications and other details of the registration of the Delhi Nursing Council.

"You may submit your statement of defence together with any other documents in support of your defence, within 15 days from the date of this notice to this office. You are directed to submit a copy of your qualification and Delhi Nursing Council registration details," the notice said.

The DMC which issued the notice on December 20 is seeking a response within 15 days.

"The notice has been sent to nine doctors and two nurses through the medical superintendent of the hospital. This time responses have been sought from these individuals," a senior DMC official said.

The Council also said that it is examining the case of alleged negligence. "The Council has taken suo motu cognisance of media reports, alleging medical negligence on the part of the doctors at Max Hospital, Shalimar Bagh," it stated.

The case had evoked a massive public outcry after which the Delhi government had resorted to canceling the hospital's license. The family of the twins sat on protest for days outside the medical facility.

"Take notice that in default of your failing to submit your statement of defence within the stipulated time, it shall be presumed that you have nothing to say in the matter and the Delhi Medical Council shall be free to initiate appropriate action," the notice said.

Meanwhile, a Delhi court in which a petition was filed in the case had asked the police to file a progress report by January 8, 2018.

THE CASE

  • On November 30, a 22-week pregnant woman gave birth to twins, of which the girl was a still-born. The hospital handed over the bodies of the twins to the family in plastic bags, to be taken for burial. Six hours later, the parents realised that one of the babies was squirming in its package.
