The sealing drive on unauthorised commercial premises in the national capital is being monitored by the Supreme Court.
Member of Parliament and Delhi BJP chief Manoj Tiwari has to appear in Supreme Court on September 25. He was caught de-sealing a Delhi premise that was sealed for unauthorised use and has been now asked to explain why he should not be punished for violating court orders.
The sealing drive on unauthorised commercial premises in the national capital is being monitored by the Supreme Court. A court-appointed monitoring committee that is carrying out the sealing activity had complained on Tuesday about Tiwari's open defiance of court orders. It also warned any person or authority from interfering with the committee's work.
The act of defiance was reported to the police and an FIR was filed on Tuesday against the MP on a complaint filed by the East Delhi Municipal Corporation (EDMC).
Tiwari has allegedly also broken the seal of certain premises in Gokalpuri in north east Delhi — the constituency he is the MP of. The premise in question is a residential building that was used as a dairy. Senior advocate Ranjit Kumar, who appeared on behalf of the monitoring committee told a bench headed by Justice Madan B Lokur that it is a grave offence and the elected representative must be punished.
The bench, also comprising Justices S Abdul Nazeer and Deepak Gupta, said, "The report points at a rather disturbing state of affairs," asking Tiwari to appear in court on Tuesday to explain why his conduct should not be punishable under the Contempt of Courts Act. "The incident indicates a defiant attitude by Member of Parliament Manoj Tiwari," added the bench.
Amicus curiae Ranjit Kumar said it is unfortunate that an elected member tried to defy the orders of the court. To make up a firm case against Tiwari, the committee even provided a footage of the MP de-sealing the premises in question. The buildings were later "re-sealed" by the committee, which comprises KJ Rao, former Advisor to the Election Commissioner Bhure Lal, and Chairman of Environment Pollution (Prevention and Control) Authority Major General (Retd) Som Jhingan.
