Bombay HC notice to BCCI, CCI on MCA petition against shifting Windies ODI, but no stay on sale of tickets

The Bombay High Court on Wednesday has issued notice to the Board for Control of Cricket in India (BCCI) and Cricket Club of India (CCI) on a petition filed by Mumbai Cricket Association. However, it did not grant interim stay on the sale of tickets for the October 29 India-West Indies one day international match to be held at the Brabourne Stadium.

The MCA has challenged the decision to shift the 4th one day cricket match between India and West Indies, to be held on October 29, from Wankhede stadium to Brabourne stadium.

A division bench of Justice B R Gavai and Justice M S Karnik, raised queries on how the plea could be maintained as the MCA did not have a committe of administrators to manage its affairs as per the Supreme Court order.

It said "You don't have board of administrators at the most you can claim is suit for damages."

"We do not intend to pass any interim order as sought by the petitioners. You (petitioners) can approach the Supreme Court if you wish to as the apex court is seized of similar matters pertaining to the MCA," Justice Gavai said.

The court directed the BCCI and the Cricket Club of India, which owns the Brabourne Stadium, to file their affidavits in response to the petitions and posted it for further hearing on October 24.

The MCA and its two members - Sanjay Naik and Ravi Savant - said the BCCI's decision was illegal, arbitrary and bad in law. 

Senior advocate MM Vashi informed the court that "CCI is a private club, as per standards laid down by ICC, pitches have to be maintained, but CCI has not hosted a match since 2009".

Vashi added that the decision taken by the BCCI was “totally arbitrary, bad and illegal”.

The MCA submitted that it had taken all the necessary steps to hold the match but BCCI shifted the match without any intimation or giving any reason.

The petition also said that the decision was taken without giving any personal hearing.

The court has posted the matter for further hearing to October 24.
