Gujarat High Court asks state govt to pay doctors their due

The additional burden is expected to cost the government Rs 125 to Rs 250 crore

A division bench of Gujarat High Court has asked the state government to pay around 10,000 doctors their salary dues.

The dues are expected to be around Rs1.25 lakh to Rs2.5 lakh per doctor.

The case concerns a petition filed by one Mahesh Kapadia and the Medical officers Association which had stated that between 2005 and 2009 the government had through faulty calculation not paid them dearness allowance (DA) as well as non practicing allowance (NPA).

The doctors had in the petition contended that thanks to the faulty calculation the doctors instead of getting a hike in salary ended up having their salary reduced.

The high court had ruled in favour of the doctors but as the government failed to follow the court's order, the association filed a contempt petition.

The government following this, filed a special leave petition and made an argument that the dearness allowance calculation shown by the association was wrong and the doctors had no right to the NPA.

The division bench had rejected the government's argument and asked the state to pay the doctors their arrears due to them.
