Senior lawyer seeks contempt action against Bar Council of India

The Bar Council of India (BCI) may have successfully held a nation-wide strike protesting the Higher Education and Research (HER) Bill, but this has invited a letter from a senior advocate seeking contempt action against the body and its counterpart in the state.

MP Vashi has written a letter to the Chief Justice of India and other Supreme Court judges seeking initiation of suo moto contempt action against the chairman and other members of the BCI and Bar Council of Maharashtra and Goa (BCMG).

Lawyers across the country had participated in the strike called by the BC on July 11 and 12 to protest against the HER Bill, It accused the government of trying to usurp the power of advocates’ apex statutory body to regulate legal education and the profession in the country.

Calling the strike “unjustified, illegal, irrational and selfish,” Vashi’s letter states that the same is liable to be condemned. The letter adds: “It is surprising that most of the advocates who went on strike were unaware of the salient features of the proposed bill.” The letter further states that all elected members of bar councils are aware of the Supreme Court’s views on the boycott of courts by advocates.

Vashi’s letter further adds, “A soft corner for the bar council can be judged from the fact that the chief justice of the Bombay high court and other judges will be attending a seminar organized by the BCMG in Pune on July 14.”

Vashi has sent a copy of this letter to chief justice Mohit Shah, the chairman of BCI, the law minister of India and the advocate general of Maharashtra and Goa.
