Open car parking not for sale: MahaRERA

While hearing two cases, the Maharashtra Real Estate Regulatory Authority (MahaRERA) held that no developer can sell an open car parking to the homebuyer. Both the complaints were filed against Arkade Realty, and in both the cases the home buyers had alleged that the developer was selling open car parking by collecting cash without any documentation. The developer refuted the allegations.

Both the complainants, residents in the developers project, said that they were seeking direction from MahaRERA to the developer to allow them to park their vehicle inside the building's compound wall. During the hearing of the second complaint, the homebuyer reiterated his contention and prayed for direction to the developer to give in writing that his vehicle be allowed to be parked in the building.

Chairman of the authority, Gautam Chaterjee, held that, "We direct the developer to allow parking of the homebuyer's vehicle in the premises as is being done for other allottees. As per the act rules and regulations, the developer cannot sell open parking space which has to be handed over to the legal entity of the allottees (housing society) when it is formed."
