But the parents play the villain's role and do not let them marry because of caste difference. In reality, when the lovers eloped, the girl's family with the help of police caught them. But in this case the court came to their rescue and united the two.

    Salman Shaikh, 19, and Heenabanu Chipa, 19 are both residents of  Juhapura. While Shaikh is the son of a businessman, Chipa's father is a shopkeeper. Shaikh and Chipa had met while they studied together in sixth grade. They soon became friends and decided to get married as soon as they reached the right age for marriage.

    When Chipa completed 18 years, Shaikh approached her family and formally proposed to Chipa. The family declined Shaikh's proposal giving difference in caste as the reason. "As Chipa's family declined permission for the marriage, we decided to run away. We got married as per the rituals on May 9," said Shaikh.

    Meanwhile Chipa's father filed a complaint with the Vejalpur police. When the couple visited the police station, the police took Chipa into custody. While Shaikh was not yet 21- years-old, the girl was sent to Mahila Vikas Gruh.

    Talking to DNA, Shaikh alleged that whenever he had gone to meet Chipa in Vikas Gruh, he was denied entry and thus he moved the court seeking his wife's custody.

    On the one hand Shaikh was trying to get Chipa's custody, on the other she went on fast for not being allowed to meet her husband.

    Fighting for Shaikh, advocate Nisar Vaidya said as per Islamic laws, minimum age for marriage is 15 years and hence they should be allowed to stay together. Shaikh should thus be handed over Chipa's custody.

    The court united the couple and granted the custody of Chipa to her husband. It observed that, "The girl has given a statement that she wants to stay with her husband. Moreover, the girl is 19 years and has studied till grade Xth. In such a case she is mature enough to take the decision on her own. In such circumstances, we will allow her to go with her husband only on the condition that the boy has to give assurance that he would not abandon her."
