Apex court bail for Rathore upsets Ruchika’s family

CBI also decided to drop cases of abetment to suicide and tampering of post mortem report against Rathore for want of evidence.

Much to the anguish of Ruchika Girhotra’s relatives and friends, Harayana’s disgraced former DGP SPS Rathore had a second day of joy, as the Supreme Court (SC) granted him bail on Thursday, a day after CBI closed investigations into two cases against him.

Rathore had been serving 18-month months jail term  for molesting Ruchika in 1990.

A bench of justices P Sathasivam and BS Chauhan, however, asked Rathore not to “leave the country without specific permission of the chief judicial magistrate, Chandigarh”. Rathore has already surrendered his passport.

With this, Ruchika’s family members’ hopes to bring Rathore to justice dashed. Rathore had been convicted of molesting the teenage girl and had been accused of abetting her suicide, besides trying to tamper with her post mortem report.

CBI also decided to drop cases of abetment to suicide and tampering of post mortem report against Rathore for want of evidence.

“CBI did not oppose his bail in SC and now it has decided to drop two serious cases against Rathore. It is clearly favouring Rathore,”Ruchika’s father SC Girhotra said.

Two FIRs were registered against Rathore  by the Panchkula police in Haryana on non-bailable charges like attempt to murder, criminal intimidation, forging evidence, wrongful confinement, fabricating false evidence, custodial torture and criminal conspiracy. 

The cases were later transferred to the CBI. In its closure report filed in the Ambala court, CBI claimed that the allegations could not be proved only on the basis of documentary evidence and oral testimony of witnesses.

Girhotra said he would approach the union home ministry to get justice for his daughter. “We are feeling insecure after hearing that Rathore would be released on bail. We were expecting exemplary punishment for him,” said Girhotra.
