The VHP leader said two members of the Muslim Personal Law Board have raised objection to the “absence of any Muslim judge” on the bench.
After the Supreme Court deferred hearing on the Ram Janmabhoomi-Babri Masjid title dispute case to January 29 and Justice UU Lalit recused himself, both the VHP and the RSS on Thursday said “delaying tactics are being employed” in the sensitive case.
“Hindus are known for their patience and forbearance. The judicial system still has the responsibility to decide on the matters without undue delays,” said VHP chief Alok Kumar.
Justice Lalit, who was part of a five-judge Constitution Bench headed by CJI Ranjan Gogoi, opted out of the hearing when senior advocate Rajeev Dhavan – counsel for a Muslim party – said he had appeared for former Uttar Pradesh Chief Minister Kalyan Singh as a lawyer in 1997. The Supreme Court will constitute a fresh five-judge Constitution bench to hear the case.
“Our apprehensions that the opposite party will raise frivolous issues to secure an adjournment have come true. The objection that a judicial order should have been passed for the constitution of a five judge bench is apparently frivolous,” the international working president said in a statement.
Calling the objection to Justice Lalit’s presence as “ploys” to delay the case further, Kumar said, “Justice Lalit has never appeared in Ram Janmabhoomi case hearings; neither at the trial stage nor in the appeal. His being Counsel of Kalyan Singh in the contempt matter casts no shadow on his hearing the present appeals.”
