Accused of forgery and cheating, Abdul Rehman, the caretaker of Batla house, where two alleged operatives of the Indian Mujahideen (IM) were killed in an encounter in 2008, was discharged by a city court on Tuesday.

Mohsin Nissar, owner of flat no. L-18 in the Batla House locality, accused Rehman, a stenographer in Ghaziabad of forging his signature on a lease deed and renting out the flat to two suspected terrorists.

Representing Rehman, advocate MS Khan submitted that the police had failed to produce the original lease deed -- a crucial piece of evidence, that was allegedly forged by Rehman. Khan added that forensic reports could not be given since the police failed to give the lab the original rent agreement.

"The order for framing of charge against Rehman for offence under section 420 (cheating) Indian Penal Code is not sustainable in the eyes of law," the court said passing its order on a revision petition filed by Rehman.

On May 30, 2015, the Delhi Police had filed a chargesheet accusing Rehman under sections 420 (cheating), 468 (forgery) and 471 (using forged document as genuine) of the Indian Penal Code. However, on November 8, 2016 the trial court dropped forgery charges against Rehman and simply accused him of cheating.

Thereafter, Rehman had filed a revision petition against these charges on the grounds that there was no evidence or material of any nature showing a prima facie case against him.

WHAT HAPPENED?

Operation Batla House took place on September 19, 2008, against suspected IM operatives who were holed up in Batla House locality of Jamia Nagar, in South-east Delhi. The operatives were allegedly responsible for carrying out synchronied blasts in the national capital on September 13, 2008 in which at least 30 people were killed and over 100 injured
