Authorities warn builders of action for not registering flats

The Stamp Department said that the district administration is miffed with the builders for offering possession of flats before execution of registry

The Gautam Budh Nagar District Magistrate BN Singh on Tuesday warned the builders and 10,318 homebuyers to either register their flats before March this year or pay a heavy penalty. The builders and officials of the District Stamp Department were present in the meeting held by the DM in Greater Noida.

An official of the Stamp Department said that the district administration is miffed with the builders for offering possession of flats before execution of registry. Officials said living in flats without the execution of registry is illegal and that the government is losing out nearly Rs 334.13 crore in stamp fee. "There are seven builders who gave the possession of flats without a registry, which include Amrapali Group, Divine India Pvt.ltd, Assotech Celeste Towers in Sector-44 of

Noida, Victory crossroad in Sector-143, Man Realty Private Limited, M/s Man Realty Pvt Ltd, Ajnara Homes Group and Gardenia Glory groups.

Singh commenting on the issue said, "We found that the builders in the district gave the possession of flats without the registration. "These 10,318 flats are located in Noida and Greater Noida area.

"We called more than 15 builders for a meeting at the district headquarters and told them to either get the registry done or be ready to face action. We also asked the officials of the stamp department to issue notices to all such builders within a week and take action to register an FIR under Section-64C of the Stamp Act. It is well known that there is a 3-month jail term and Rs 10,000 as a penalty for it," Singh said.

"The district administration will act against the builder first and then against the homebuyers," an official said. " The District Magistrate also directed the officers of the Stamp Department to inspect the buildings that have been given the occupancy and completion certificate by the authorities to check whether all the buildings have been registered, and if any buyers are found living without the registry, action should be taken against the builders in that respect so that the government can get more and more stamp revenue," the official added.
