Submit report of liquor seizures to Enforcement Directorate: DG Shivanand Jha

In a bid to further corner the bootlegging syndicates, State's Director General of Police (DGP) Shivanand Jha has asked the police department to share findings of investigations into big liquor seizures with the Enforcement Directorate so as to enable it to initiate proceedings under the Prevention of Money Laundering Act (PMLA).

In a circular dated May 2, DGP Shivanand Jha directed that that investigation into all seizures of Indian Made Foreign Liquor (IMFL) valued at Rs 20 lakh or more would henceforth be closely monitored by concerned IG / DIG in case of districts, concerned joint/additional commissioner in case of police commissionerates, and concerned IG / DIG in case of other investigating agencies.

"They will ensure that Sections 81 and 83 of Gujarat Prohibition Act are applied to such cases, and thorough investigation is made into all aspects of the bootlegging activity to conclusively establish whether the activity was being pursued as an organised crime," the circular read.

The DGP directed that in case of an affirmative finding, the official would ensure charge sheet is submitted in the prohibition case against all members of the crime syndicate on top priority and with a detailed account of the manner in which they had committed scheduled offences to facilitate bootlegging.

"In addition, the official shall submit a detailed report to the DGP / ADGP to communicate those findings to the Enforcement Directorate for contemplating invoking of provisions of PMLA against those accused who may have acquired significant proceeds of the crime as members of the bootlegging syndicate," the circular added.

The circular also directed senior officials to probe the legality or otherwise of the manufacturing of the seized liquor, the genuineness of documents used for transporting the liquor, the involvement of accused persons in similar offences in the past, and other aspects of the case.
