Big day for Srinivasan as Supreme Court to hear his case

Tuesday could be a big day for Board of Control for Cricket in India’s secretary N Srinivasan. The Supreme Court will hear a Special Leave Petition filed against him by former BCCI president AC Muthiah.

As per the Apex Court’s daily Cause List, the case of conflict of interest against Srinivasan is slated for final disposal on Tuesday.
Muthiah had gone to the Supreme Court asking for disqualification of the board secretary contending that Srinivasan cannot be an owner of the IPL team Chennai Super Kings and also simultaneously hold the post of an office bearer.

The Madras high court had twice dismissed the appeal finding “absolutely no merit’’ in it and many in the BCCI are confident that Muthiah’s plea will again be rejected by the country’s highest court. But Muthiah backers say it is a strong case against the BCCI secretary, who they claim has ‘fudged’ some
documents.

Muthiah knocked the doors of the Apex Court on March 24. Admitting the petition, the court asked the BCCI and Srinivasan to
respond in six weeks and slotted the case for second week of August. Justice JM Panchal and Justice Gyan Sudha Mishra are set to hear the case.

Tuesday’s verdict may have immediate impact on future of Srinivasan, who is expected to be formally elected as president-elect of the Board next month. Muthiah had filed the case against Srinivasan just before he was to be elected secretary a couple of years ago.

There is a strong perception in the Board circle that Muthiah’s legal battle has got the moral backing of Lalit Modi, Srinivasan’s other adversary. Many actually believe that Modi was hoping for an injunction from the Supreme Court and hence was trying to delay the meeting of the Governing Council (GC), which eventually was called by BCCI president Shashank Manohar before suspending him as the IPL chairman.

“We’re confident there is no merit in the case. But these are certainly anxious moments for us,” said an aide of Srinivasan. Eminent lawyer Ram Jethmalani is expected to argue for Muthiah while from the BCCI side it could be R Nariman.

The case, however, may also go on for more time. “It is up to the honourable judges. It is not necessary that the case could be disposed off tomorrow itself,” said a legal expert.

IPL GC to meet on Aug 20?
The Board of Control for Cricket in India is believed to have slated three important meetings in Mumbai on August 20. It has been learnt that the finance committee, working committee will meet that day. The other meeting could be of the governing council of the Indian Premier League. The agenda for the meetings are not yet known but the finance and working committees are expected to clear the accounts for the year which will be submitted at next month’s annual general meeting of the Board.
