Supreme Court rejects plea to advance BCCI Annual General Meeting

The Supreme Court, on Monday, refused to pass any order on the plea of Cricket Association of Bihar (CAB) to advance BCCI's Annual General Meeting (AGM) so that the cricket body's ousted President N Srinivasan will be prevented from participating in it.

The AGM is scheduled to be held on November 20. It is widely speculated that Srinivasan, who is now chairman of the International Cricket Council (ICC), wants to carry on as the BCCI head.

Refusing to advance the dates of the AGM, the court asked BCCI to file the reply and posted the matter for November 10.

A bench headed by Justice TS Thakur made it clear that the Justice Mukul Mudgal committee, probing into allegations against Srinivasan and 12 others including some cricketers in IPL betting and spot-fixing scandal, will submit its final report by that time.

"Let us wait for the report of the probe committee. Let the decks be cleared for the elections. We had given the last order allowing Srinivasan to participate in the election but he will not hold the office of president till further order.
"Till then you keep quiet. We are not concerned at this stage with the AGM. Please wait till the report is filed by the panel," the bench also comprising Justices FMI Kalifulla said.

Aditya Verma of the unrecognised Cricket Association of Bihar has filed a petition on the grounds that BCCI flouted its constitution by deferring the AGM by almost two months.

He also sought the court to declare the working committee and continuance of its office bearers as illegal due to the failure of the BCCI to hold its elections prior to September 30.

Senior advocate Nalini Chidamabaram, appearing for the CAB, submitted that since the AGM was not held prior to September 30, no office bearers have locus standi to continue in the working committee of the BCCI.

She also submitted that since Srinivasan has been directed by this court not to function as president of the BCCI, how could he contest the coming polls.

Countering the arguments, BCCI counsel questioned CAB's locus saying "the petitioner association is not a member of the board and the court should not allow his plea".

The counsel also informed the bench that the Registrar of Cooperative Society has allowed it to hold the AGM on November 20 and a petition against it is pending in the Bombay High Court.
