Governor asks GU to take action in Thakkar case

After considering petitions filed by other complainants, the governor has asked the Gujarat University (GU) to take necessary action in the case of Jashwant Thakkar.

Hasmukh Adhiya, principal secretary, education department, issued an order on February 2, stating that the decision of the GU to cancel the nomination form of Jashwant Thakkar is unlawful. It also stated that 'GU should consider representation of the petitioner under section 56 of the University Act, according to which the university should schedule a poll for a vacant seat; and under the provisions stipulated in statute 138 and 139 the vice chancellor has the authority for it in case of a possible situation.'

The case of Jashwant Thakkar is crucial because without a final decision, election of the GU executive council may not be possible.

The government has declared GU's decision to cancel the nomination form of Jashwant Thakkar as unlawful for the second time. Jashwant Thakkar, professor of SLU College had appealed in the high court (HC) against the decision of the then vice chancellor AU Patel, which forbade him to contest in GU's court election held in 2005.

Thakkar alleged that he was being intentionally kept out of the election process of the senate because he was raising issues against the VC's slackness in administration and others related to students, professors and employees, when he was in the last senate.

When the nominations were being filed, Thakkar was out of the country. He tried to file his nomination by giving an authority letter to his brother Suresh, but the form was rejected by the GU authorities. He was told that the candidates are required to come personally to file their nomination. But there is no such law in GU's statute 147. Even then, Thakkar tried submitting his nomination through a courier but his name was still not included in the final list of candidates for the election.

Later, Thakkar filed a writ petition in the HC but the elections were already through by then. The court took the petition as an appeal and ordered Gujarat government to take decision on the matter within three months. When Thakkar received no response from the government he went on to file a contempt application in the HC, which is still pending.

Meanwhile, the case was also taken for hearing by P Paneervel, the then principal secretary for education department. GU Vice chancellor Parimal Trivedi was not available for comment.
