Moving courts is a luxury few can afford, says SC

Confirming people’s perception that moving a court for justice was a five-star luxury that few could afford, the Supreme Court on Tuesday observed that only those “who have Rs50 crore or Rs100 crore or Rs200 crore” could come to the court.

The common man cannot even afford to come to court for justice. “Why Supreme Court, it would even be difficult for them to approach the Munsif court,” a bench of justices BN Aggrawal, GS Singhvi and Aftab Alam observed while hearing an appeal by criminal lawyers RK Anand and IU Khan, debarred from practising in courts for four months.

The Delhi high court had debarred them in connection with a sting operation by a TV channel alleging that a crucial witness in the BMW car rage case had been bought over by the lawyers.

Cautioning that unless corrective measures are taken the justice system would lose people’s confidence, the court remarked, “We are a party to it. You (advocates) are a party to it. We should ponder over it”. “Otherwise they (common people) will soon become beggars,” the judges warned.

They also regretted the absence of proper libel laws in the country to prevent the media from overreaching or defaming individuals. “It is a misfortune for the country,” the court remarked when TV channel’s lawyer Harish Salve said libel laws in Britain deter the media from indulging in recklessness and slander.

The media’s role has to be seen in the context of growing corruption in the country and the general perception that we are corrupt, Salve said. “There is a lot of carelessness. With all the carelessness they are doing some good work,” he said.

“Today anybody will believe corruption charges against anybody. Lot of us have become corrupt,” he said, supporting the argument that the country in general has become corrupt.
